Assumption of Risk - Release - Waiver of Liability & Indemnity Agreement

This information is very important, please read it carefully. All participants are required to sign this liability release form prior to embarking on a tour purchased with Nepal Wheel Tours P. Ltd. It is the responsibility of the client to read and agree to these Terms and Conditions before signing up for any tours or making payment. Your signature below signifies your agreement with the following terms and conditions.

Nepal Wheel Tours P. Ltd, LLC (NWT) tour package you buy links with airline, hotel, and Vehicle Company or other service provider (Suppliers). NWT is not responsible for acts or omissions of the Suppliers or their failure to provide services or adhere to their own schedules. The suppliers or independent contractors providing transportation, accommodations and all other services are not agents or employees of NWT. 

By utilizing the services of all suppliers, clients agrees that neither NWT, nor any representatives shall be liable for any accident, injury, including loss of life, damage, loss, delay, irregularity or expenses arising from acts of God, strikes, war, weather, quarantines, sickness, terrorist activity, government restrictions or regulations, from any act or omission of any individual, firm, or corporation furnishing transportation, sight-seeing, accommodations, or any services in connection with such tour plans or from any other occurrences whatsoever. All such expenses or losses are the responsibility of the client. By commencing a tour, the client willingly assumes all risks and responsibilities expected or unexpectedly involved with the purchased tour. We urge purchase of travel insurance to protect against such risks, including tour cancellation due to unanticipated events.

Tour Prices: Current tour prices listed or negotiated with each tour are subject to change with the fluctuation of currencies, supplier increases, fuel and other surcharges and other reasons beyond our control, until full payment is received. All quoted prices including the cost of tour operator planning and operation. Each tour lists the items that are included in that specific tour. Please refer to the tour itinerary you are joining for pricing and inclusions.

Cost Not Included in Tour: Those items not listed in the proposed itinerary, including the following: passport, visa & custom fees, departure and airport taxes & International airlines fees, phone calls, Internet/WIFI, Health, Accident, Baggage & Trip Cancellation Insurance; and other services not listed. Please note Porterage, room service, laundry, excess baggage charge, a la carte meals, alcoholic beverages and bottled or canned drinks, hot drinking water or shower in the mountains, paid toilets etc. are not included unless specifically mentioned as included in the Itinerary. Such expenses shall be directly paid by you. All personal expenses are excluded.

All services will be as per those specified / confirmed and paid for as per tour service inclusions and your travel insurance policy. However, in case you avail any service/itinerary directly from third party suppliers, which is not included in the Tour Package or gets upgraded directly, then you will have to directly make payment for the same to the concerned third party supplier. 

No refund will be given on commencement of first leg of journey or on partly utilized Tour Package or extended for reasons beyond our control except domestic airfare (excluding fuel surcharge) with 10% carrier’s cancellation charges. It also includes declining a committed trip for reasons otherwise of your free will or against and if there is no show for trip departure on a given date. In the event of cancellation / rescheduling of flight, if hotel rooms and flight seats are available for the subsequent day or on an alternative schedule, then to the extent possible, you shall be accommodated however this shall not be a matter of right for you and neither an obligation for Nepal Wheel Tours P. Ltd

Payment of Tour: Payment of tour to be made through wire transfer only. Payment by credit card will incur a processing fee of 4.5% of the amount paid by credit card. Final payments are due 60 days prior to arrival unless stipulated otherwise with specific understanding.

Changes to Reservation: Once initial payment has been made for a tour reservation, all change requests must be received in writing. NWT is subject to the rules and fees of third party suppliers and thus change requests are not guaranteed. If change is possible, all fees by the supplier, as well as an administrative fee will be added to the reservation cost.

Cancellation Fees: Unless stated differently on tour flier, cancellations received 120 days prior to departure date will be refunded in full less a 10% handling fee. Thereafter, cancellation fees are as follows:

• 119 to 90 days prior to departure = 25% of tour cost
• 89 to 60 days prior to departure = 50% of tour cost
• 59 to 30 days prior to departure = 75% of tour cost
• 29 days prior to departure forfeits full tour price, including no shows.

Refund if Any: Regardless of your arrival to Nepal in time for the tour, trips or expedition; in addition if a case of postponement or overall cancellation arises further than control and capacity of Nepal Wheel Tours P. Ltd or assigned suppliers. Refund of deposits and/or payments will be returned less the amount of service used. All due refunds will be in Nepalese Rupees according to foreign exchange policy of the Government of Nepal. Airlines, tour operators and other suppliers have their own contracts covering cancellation penalties and other terms and conditions. You may be bound by those contracts regardless of whether you receive notice of their terms.

Trip Cancellation, Health, Accident and Medical Evacuation & Baggage Insurance: For client protection comprehensive travel insurance is highly recommended and in the best interest of each traveler, to protect yourself before and during the trip. Unless indicated in the tour description, travel insurance is not included in the price of the tours. 

Passports: Passport must be valid for at least 6 months beyond the anticipated tour end date if connecting tours of Tibet or Bhutan through NWT. Passengers who are denied boarding or entry for improper documentation will not be eligible for a refund of any amount. 

Transportation and Transfers: The type of transportation varies by areas of interest, group size, and season. Transfers may not be included, so check the specific itinerary. In the event you miss a scheduled departure for any tour, transfer or event, it is your responsibility to arrange transportation to the next arrival/departure point or hotel to begin or rejoin the scheduled tour/itinerary. No refunds will be issued for missed transportation or delayed arrival.

Baggage: Guests are responsible for what you carry and must conform to all international/domestic air carrier restrictions, excess baggage fees, and are responsible for their personal luggage during the tour. We recommend one bag/suitcase per person, plus a small carry-on. We request that only one bag per person be used on van tours. We recommend you purchase Travel Insurance with baggage protection.

Photography, Video & Testimonials: Any likeness or image of you secured or taken on any of our tours may be used by NWT without charge in all media (whether now existing or in the future invented) for bona fide promotional or marketing purposes, including without limitation promotional materials of any type such as brochures, slides, video shows or the internet. Any written feedback supplied to the company may also be used for promotional purposes as detailed above.

Mobility and Fitness to Travel: NTW reserves the right not to accept or retain as a tour participant any person whose physical/mental condition or general deportment impedes the operation of the tour or affects the rights, welfare, or harassments of other tour participants or for any other reason. If a person is required to leave a tour it will be considered an unused portion and non-refundable, and they will be responsible for all their expenses to return home including any rebooking fees by airlines and/or suppliers.

Responsibility of Nepal Wheel Tours P. Ltd, LLC: The invalidity or unenforceability of any part of this Agreement, or the invalidity of its application to a specific situation or circumstance, shall not affect the validity of the remainder of this Agreement, or its application to other situations or circumstances.

Responsibility of Traveler: Any provision of this Agreement held invalid or unenforceable only in part or degree will remain in full force and effect to the extent not held invalid or unenforceable.

Claims or Disputes/Arbitration: In the event of a dispute or claim made by the client concerning, relating or referring to this Agreement, promotion of tour, tour inclusions, performance of NWT or any claim made against NWT, Nepal Wheel Tours P. Ltd will make every effort to resolve said dispute or claim between the individual parties involved. If the dispute or claim cannot be resolved between the traveler and NWT, the traveler agrees that any dispute or claim shall be resolved exclusively by binding arbitration according to the existing rules of the Nepalese Law. In connection with any action or legal proceeding arising out of this Agreement, the parties hereby specifically and knowingly waive any rights that either party might have to demand a jury trial.

Upon making a deposit to NWT, you constitute full knowledge, acceptance and consent by the participant to all provisions in the tour brochure; the website, General Information, Terms and Conditions; the Registration Form, and all other release forms. 

All members participating with Nepal Wheel Tours P. Ltd or its assigned supplier should be protected by their Travel & Medical Insurance that covers any event of Accident, Health Emergency evacuation (travel insurance that permits you to journey above 2000m, and loss / damages of personal effects. By joining the trip you hereby agree to take the responsibility; to pay all medical expenses that may include rescue by helicopter and other contingencies in getting to safety for proper medical care by signing this release form.

Liability Release: I have fully read and am aware of the order limited in trip itineraries and other written materials subjected by Nepal Wheel Tours P. Ltd. I have agreed to join this trip on my own free will. I acknowledge conditions made clear in this printed material and are prepared to cope with any situations or circumstances that may arise with my tour / trips. 

I recognize the realities made clear in this written information that reflects the intrinsic characteristics of adventure travel and not least the matter of flexibility, adaptability and equanimity to practical and personal lifestyle on tour / trip. I do take into account the facts that not all situations, circumstances or conditions subsequently encountered are identical to use comparably to preexisting and prevailing time of joining the tour / trips. 

I am fully aware that tours / trips are adventurous and include vital factors of personal risk. Sometimes these factors take toll unknowingly. I acknowledge the relative remoteness, rough traveling and weather conditions, and the limited and relatively primitive medical and other services available during the tour, as well as greater potential dangers compared with my usual daily life or conventional holiday travel. 

By accepting this Agreement, it further signifies my intentions to relieve Nepal Wheel Tours P. Ltd, its owners, officers, directors, employees, agents, contractors, and subcontractors from any liability for personal injury, property damage, or wrongful death which I might suffer during my travels on the scheduled tour. In addition, I have noted the policy on cancellations, refunds, and limitations of responsibility and will indemnify NWT for any additional cost that may arise in course of needful action.

I am the parent or guardian of the minor child(ren) whose name(s) appear on the attached tour agreement(s) and whose names are listed below. I have acknowledged receipt of the attached tour agreement, read its contents and am satisfied with, and in agreement with the contents therein.
